A 41-year-old man pleaded guilty Thursday to two firearm charges that stem from an incident at a Halloween party in James City County.

Tommy Underwood was sentenced to 24 months in jail with all but four months suspended for pulling a gun on a neighbor in the Fox Ridge subdivision Nov. 1.

He pleaded guilty to two misdemeanor counts of brandishing a firearm.

A criminal complaint filed in Williamsburg-James City County General District Court states Underwood, who had been drinking at the party, argued with some of the attendees and pulled a gun from his waistband.

Police said Underwood threatened to shoot one of his neighbors in the knee.

Underwood left the party at one point and came back a short time later, explaining he wanted to apologize to the homeowner.

He then went up to the homeowner and pulled a black handgun from behind his back, the officer wrote in the complaint.

Witnesses were able to knock the gun from his hands, and Underwood retreated to his home, saying “that’s okay, I have more at home.”

Officers arrived at the party and located Underwood in the area.

A third count of brandishing a firearm was dropped at a hearing in Williamsburg-James City County General District Court on Thursday.
