A man is facing numerous charges after he tried to flee from James City County Police in a vehicle and on foot when officers found him passed out in the drivers seat with an open beer can and pills in the car.
Four officers dispatched to Merrimac Trail around 5 p.m. July 28 for a suspicious vehicle found 41-year-old Delbert W. Foster passed out in the drivers seat of a 1990 Honda with the engine running, said Stephanie Williams-Ortery, spokesperson for the James City County Police Department.
Officers saw an open beer bottle in the passenger seat and an open case of beer in the back seat. After several attempts, officers were able to wake Foster and were attempting to speak to him when he revved his engine and took off driving.
Foster began to drive recklessly around the area of Merrimac Trail and Turkey Road, passing vehicles on the right and left sides, Williams-Ortery said. He ran off the road and around the back of a building, then got out of his vehicle and began running on foot.
He was caught and taken into custody. Once at the jail, he refused breathalyzer tests.
Pills were found when officers searched his car, Williams-Ortery said.
Foster has been charged with a felony count of evading and eluding a police officer, a felony count of driving under the influence as a third or subsequent offense, a felony count of driving after being declared habitual, one misdemeanor count of refusing a breath and blood test, one misdemeanor of operating a vehicle without inspection, one misdemeanor count of having an open container and one misdemeanor count of possessing prescription medication not prescribed to him and not in a proper container.
